Terms of service

1. Acceptance of terms

By downloading, installing, or using the Swolemates mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Swolemates ("we," "us," or "our") reserves the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.

3. Account registration

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. User responsibilities and acceptable use

You agree to use the App only for lawful purposes. You may not:

  • Use the App in any way that violates applicable laws or regulations
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity
  • Harass, bully, threaten, or intimidate other users
  • Post or share content that is hateful, violent, sexually explicit, or otherwise objectionable
  • Attempt to gain unauthorized access to the App, other user accounts, or our systems
  • Use automated scripts, bots, or other means to interact with the App
  • Interfere with or disrupt the integrity or performance of the App
  • Reverse engineer, decompile, or disassemble any part of the App

We reserve the right to suspend or terminate your account if you violate these terms.

5. Subscriptions and payments

Swolemates offers both free and paid subscription plans. Paid plans provide access to premium features.

  • Free tier: Basic access to the App with limited features.
  • Paid plans: Premium features are available through subscription plans billed annually. Pricing details are displayed in the App at the time of purchase.

Subscriptions are processed through the Apple App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your App Store account settings.

Refunds are handled in accordance with Apple's refund policies.

6. User content

You may submit content through the App, including workout data, profile information, and social interactions ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content in connection with operating the App.

You are solely responsible for your User Content. We do not endorse any User Content and are not liable for any content posted by users.

7. Intellectual property

The App and its original content (excluding User Content), features, and functionality are owned by Swolemates and are protected by copyright, trademark, and other intellectual property laws. The Swolemates name, logo, pixel art assets, and all related graphics are trademarks of Swolemates. You may not use our trademarks without prior written consent.

8. Health disclaimer

Swolemates is a fitness accountability and social app. It is not a medical or health service. The App does not provide medical advice, diagnosis, or treatment. Always consult a qualified health professional before beginning any exercise program. You use the App and follow any workout routines at your own risk.

9. Limitation of liability

To the maximum extent permitted by applicable law, Swolemates and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Disclaimer of warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

11. Indemnification

You agree to indemnify, defend, and hold harmless Swolemates and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time through the App settings. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

13. Apple App Store terms

The following additional terms apply when you download the App from the Apple App Store:

  • These Terms are between you and Swolemates, not Apple. Swolemates is solely responsible for the App and its content.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims relating to the App or your use of the App.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Changes to these terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
